1. Acceptance of Terms

By accessing or using SiteAI ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Service Provider

SiteAI is a service operated by Nordic Hosting AS, org.nr 989 383 930, Stasjonsvegen 21A, 3800 Bø i Telemark, Norway.

3. Description of Service

SiteAI is an AI-powered website builder that creates and maintains websites based on user input. The Service includes website generation, hosting, domain management, and related tools.

Technical scope: SiteAI generates and hosts static websites (HTML, CSS, and client-side JavaScript) served via a global CDN. The Service does not include and cannot create: server-side applications, backend APIs, user authentication or login systems, custom admin panels, relational databases, or any functionality requiring a dedicated server process. Optional add-ons (e-commerce, booking, AI chat, analytics) extend the static site with pre-built SiteAI-hosted backend integrations.

When a customer request cannot be fulfilled within these technical constraints, the AI will notify the customer in the update confirmation it sends after each change, explaining what was done and what could not be done.

4. Account Registration

  • You must provide accurate and complete information
  • You are responsible for maintaining the security of your account
  • You must be at least 16 years old to use the Service
  • One person or entity per account — no shared accounts

By registering, you agree to these Terms of Service and our Privacy Policy.

5. Subscriptions and Billing

  • Paid plans are billed monthly in advance
  • You can upgrade, downgrade, or cancel at any time
  • Downgrades take effect at the end of the current billing period
  • No refunds for partial months, except where required by law
  • We reserve the right to change pricing with 30 days notice

6. Right of Withdrawal

Under the EU Consumer Rights Directive, you have 14 days to withdraw from a digital service purchase without giving a reason. However, by starting to use the Service immediately after purchase, you expressly consent to the performance of the Service beginning before the withdrawal period expires, and acknowledge that you thereby lose your right of withdrawal. For annual plans, if you have not used the Service (no projects created), you may request a full refund within 14 days.

7. Free Plan

The free plan includes limited features and is hosted on a SiteAI subdomain. Free plan websites may display a small "Built with SiteAI" badge. We reserve the right to remove inactive free websites after 90 days of inactivity.

8. Your Content

  • You retain ownership of all content you provide to the Service
  • You grant us a license to host, display, and process your content as needed to provide the Service
  • You are responsible for ensuring your content does not violate any laws or third-party rights
  • We may remove content that violates these terms
  • SiteAI uses automated systems to moderate content before and after publication
  • We reserve the right to remove, block, or refuse publication of content that we, at our sole discretion, consider inappropriate, harmful, illegal, or in violation of these terms
  • Content blocked by our moderation systems cannot be demanded published
  • We are not obligated to provide advance notice when removing content that violates our guidelines
  • You will be notified when content is removed, with the opportunity to appeal within 14 days

9. AI-Generated Content and Disclaimer

(a) Websites and content built by our AI are generated based on your input. AI-generated content may contain errors, inaccuracies, outdated information, or inappropriate material. We do not guarantee that any AI-generated content is error-free, factually accurate, complete, or fit for any particular purpose. (b) You are solely responsible for reviewing, verifying, and approving all content on your website before and after publication. You should not rely on AI-generated content for medical, legal, financial, or other professional advice. (c) SiteAI and Nordic Hosting AS expressly disclaim all liability for any loss, damage, or harm arising from reliance on AI-generated content, including but not limited to financial losses, reputational damage, or losses resulting from inaccurate or misleading information generated by the AI. (d) You agree to indemnify and hold SiteAI harmless from any claims arising from the content published on your website. (e) Partial fulfillment: Some requests may only be partially fulfilled. If a request includes features outside the technical scope described in section 3 (e.g. a server-side admin panel, user login system, or database), the AI will complete all feasible parts of the request and include an explanation of what could not be done and why in the update notification sent to you. SiteAI is not liable for functionality that is architecturally outside the static website model.

10. Intellectual Property and Code Export

(a) You retain full ownership of all content you provide (text, images, logos, business information). (b) AI-generated code, design, and website structure created for your projects are licensed to you on a non-exclusive basis for use through the SiteAI platform for the duration of your subscription. (c) Full Code Export: You may purchase a one-time full source code export of your website at the price listed on our website (excl. VAT). This grants you an irrevocable, perpetual, non-exclusive license to use, modify, and host the exported code independently of SiteAI. (d) SiteAI retains the right to use similar templates, patterns, and design approaches for other customers. (e) Upon account deletion without code export, you may export your content (text, images) but not the generated source code.

11. Prohibited Use

You may not use the Service to:

  • Create or publish sexually explicit or pornographic content
  • Create or publish hateful, discriminatory, racist, or harassing content
  • Create or publish content that glorifies or encourages violence or terrorism
  • Create or publish content that promotes illegal activities (drugs, fraud, hacking, phishing)
  • Create or publish content that promotes self-harm or suicide
  • Create or publish content that exploits or sexualizes minors (zero tolerance)
  • Create deceptive content: fake login pages, phishing clones, scam pages
  • Distribute malware, cryptominers, or tracking scripts
  • Attempt to circumvent or manipulate our AI systems or security restrictions (prompt injection)
  • Attempt to access other users' websites, data, or accounts
  • Attempt to circumvent plan limitations or access features you do not pay for
  • Infringe on intellectual property rights
  • Send spam or unsolicited communications
  • Resell the Service without authorization

12. Automated Content Moderation

  • SiteAI uses automated moderation systems to manage content on the platform
  • Content may be scanned and evaluated both before and after publication
  • Automated systems may block content deemed to be a policy violation
  • Automated systems are not infallible — you may appeal incorrect blocks
  • Appeals are processed within 5 business days

13. Availability and Uptime

We aim for high availability but do not guarantee 100% uptime. We are not liable for downtime caused by maintenance, third-party services, or events beyond our control.

14. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. WE EXPRESSLY DISCLAIM ALL WARRANTIES INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW: (a) SiteAI and Nordic Hosting AS shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to: loss of profits, loss of revenue, loss of business, loss of data, loss of goodwill, business interruption, or cost of procurement of substitute services. (b) This applies regardless of the theory of liability and even if we have been advised of the possibility of such damages. (c) Our total aggregate liability shall not exceed the total amount you have actually paid us in the twelve (12) months preceding the event, or one hundred euros (EUR 100), whichever is greater. (d) For free plan users, our total liability shall not exceed ten euros (EUR 10). (e) Nothing in these terms shall exclude or limit liability for: (i) death or personal injury caused by negligence, (ii) fraud or fraudulent misrepresentation, or (iii) any liability that cannot be excluded by applicable law.

16. Termination and Account Deletion

We may suspend or terminate your account for violation of these terms. You may delete your account at any time from your account settings. Upon account deletion: your personal data will be anonymized, active subscriptions will be cancelled immediately with no refund, all projects and websites will be permanently deleted, billing records will be retained as required by Norwegian accounting law (5 years).

We use automated systems to detect violations of our guidelines. For repeated or severe violations, your account may be automatically suspended without prior notice.

  • Upon automatic suspension: all projects are paused, you can log in to export data or appeal, active subscriptions continue to run unless you cancel
  • You may appeal a suspension by contacting [email protected] within 14 days
  • For severe violations (child exploitation, terrorism), we reserve the right to immediate permanent ban and reporting to relevant authorities

17. Governing Law

These terms are governed by and construed in accordance with the laws of Norway. For consumers within the EU/EEA, mandatory consumer protection laws of your country of residence also apply.

18. Dispute Resolution

The parties shall first attempt to resolve any dispute amicably through negotiations within 30 business days. If the parties cannot reach an agreement, the dispute may be submitted to Midt-Telemark forliksråd (conciliation board). If unresolved, Nedre Telemark tingrett shall have exclusive jurisdiction. For consumers within the EU/EEA, you may also bring proceedings in the courts of your country of residence. You may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

19. Changes to Terms

These terms carry a version number displayed at the top of this page. We may update these terms from time to time. Changes are handled as follows:

  • Notification: For material changes, we will notify you via email and an in-app message at least 30 days before the new terms take effect.
  • Acceptance period: You have 30 days from the publication date to accept the updated terms. During this period, you retain full access to the Service with a visible reminder to accept.
  • After the deadline: If you do not accept the updated terms within the deadline, your account will be suspended. You may still log in to export your data (GDPR Article 20) or delete your account, but you cannot create or edit projects.
  • Implied acceptance: Continued active use of the Service after being notified of changes constitutes acceptance of the updated terms.
  • Right to terminate: If you do not agree to the updated terms, you may terminate the Service and export your data at no cost.

Minor changes (typographical corrections, clarifications with no change in meaning) do not require re-acceptance.
